GENERAL TERMS OF SALE

PREAMBLE

These “General Terms of Sale” apply to legal operations involving products sold to customers by X-Bar within its virtual store.

DEFINITIONS:

The following words or expressions shall have the following meaning within the scope of these terms:

  • Internet Store: refers to the website on which the Products are presented and sold to customers.
  • Order: refers to the sales contract concluded between and the customer of the Internet store.
  • Product Sheet: refers to the classified information about a product provided by when offering said product for sale in its internet store.
  • Products: refers to all goods and services offered for sale by in its internet store.
  • Service: refers to the sale of Products by to customers of its Internet store.
  • Transaction: refers to all operations, secure processes, authorizations, and agreements inherent to the payment of the price of Products ordered by credit card.

ARTICLE 1 – OBJECT

These General Terms of Sale aim to define the terms and conditions under which X-Bar offers and sells its Products to customers. These general terms of sale shall prevail over any other conditions appearing in any other document, unless previously, expressly, and in writing waived.

ARTICLE 2 – ACCEPTANCE OF CONDITIONS

The customer acknowledges having read, at the time of placing the Order, these general terms of sale and expressly declares to accept them without reservation.

These general terms of sale govern the contractual relationship between and its customer, both parties accepting them without reservation.

ARTICLE 3 – PRODUCTS

The majority of products offered by X-Bar to its customers are immediately available.

However, all products marketed by may or may not necessarily be available for online sale.

ARTICLE 4 – ORDER

Automatic recording systems are considered as proof of the nature, content, and date of the Order.

X-Bar will confirm the customer’s acceptance of the Order by sending a confirmation message to the email address provided by the customer. The sale will only be concluded upon sending said order confirmation.

X-Bar reserves the right to refuse or cancel any Order from a customer, especially in the event of insolvency of the customer or in the event of a default in payment of the relevant Order or a previous delivery or a dispute relating to the payment of a previous order.

The information provided by the customer, when entering the information related to their Order, commits the customer. X-Bar cannot be held responsible for errors made by the customer in the wording of the recipient’s information for the Order (delivery address, billing address, in particular) and for delays in delivery or the inability to deliver the ordered Products that such errors may cause.

ARTICLE 5 – DELIVERY

After confirmation of the Order and subject to the perfect payment of the price of the ordered products, X-Bar commits to ship the ordered products to the delivery address within a specified period at the time of selecting the Order’s mode of transport, unless otherwise stated.

All Products specified in Orders placed with X-Bar are intended for the personal use of customers or recipients whose name is mentioned at the delivery address.

If necessary, the customer agrees to pay, upon receipt, all taxes, duties, taxes, and other charges present and future due for the delivery of said products themselves; the joint liability of X-Bar cannot be engaged at any time for this reason.

Customers or recipients of Products are prohibited from any partial or total resale of the Products.

Delivery will be made by La Poste Suivi, Colissimo, letter max, or by any other carrier according to our convenience.

In the event of a delivery delay exceeding seven (7) days, the Customer may, if desired, and unless force majeure, terminate the sales contract by registered letter with acknowledgment of receipt. However, this right must be exercised within sixty (60) working days from the initially scheduled delivery date in the contract.

Upon receipt of the ordered Products, the customer or the recipient must check the proper functioning of the delivered goods and will take note of its conditions of use as indicated in the instructions for use provided.

In the event that one or more of the ordered Products are missing or damaged, the customer or the recipient must make any reservations with the carrier at the time of delivery.

In the case of apparent defects, the customer has the right to return under the conditions provided in the instructions for using the goods.

For reasons of availability of the ordered Products, an Order may be subject to multiple successive deliveries to the customer.

In the event that the customer wishes the ordered Products to be delivered to two separate addresses, it will be necessary for the customer to place 2 separate Orders.

ARTICLE 6 – WITHDRAWAL

The customer has a period of 7 days from the receipt of the ordered Products to return them to X-Bar for exchange or refund. In this case, the customer must return the new, intact Products, accompanied by all possible accessories, instructions for use, and documentation to the following address:

In the event of exercising the right of withdrawal, X-Bar undertakes to refund the amounts paid by the customer, free of charge, except for the return costs.

The refund is due within a maximum period of 30 days.

ARTICLE 7 – SUBSCRIPTIONS: CANCELLATION AND REFUND

A refund request must be made within 7 days of payment. In the event that the ordered products have already been sent, the customer must return the new and intact products to the following address:

The request for cancellation and refund automatically terminates your subscription, except upon express request from the customer at the address support@x-bar.co.

In the event of exercising the right of withdrawal, X-Bar undertakes to refund the amounts paid by the customer, free of charge, except for the return costs, if any.

The refund is due within a maximum period of 30 days.

ARTICLE 8 – PRICE

The price is expressed in euros.

The price indicated on the Product Sheets does not include transport-related costs.

The price indicated in the Order confirmation is the final price expressed all taxes included and including VAT. This price includes the price of the Products, handling, packaging, and storage fees for the Products, as well as transport and service fees.

ARTICLE 9 – PAYMENT

The price invoiced to the customer is the price indicated on the Order confirmation sent by X-Bar.

The price of the Products is payable in cash by one of the means of payment offered on the site on the day of the effective order.

The Order validated by the customer will be considered effective only when the secure banking payment center has given its agreement on the transaction and, where applicable, after acceptance of the risk coverage by the insurer.

ARTICLE 10 – APPLICABLE LAW

These general terms of sale are subject to French law.

ARTICLE 11 – LIABILITY

X-Bar cannot be held liable for damages of any kind, both material and immaterial or bodily, that could result from a malfunction or improper use of the Products marketed.

The liability of X-Bar shall, in any event, be limited to the amount of the order. In the event of difficulties in applying this contract, the customer and reserve the right, before any legal action, to seek an amicable solution.

Otherwise, for professional customers, the Commercial Court of PARIS is solely competent, regardless of the place of delivery and the accepted payment method.

ARTICLE 12 – WARRANTY

In any case, X-Bar cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the country of receipt. The responsibility of X-Bar is systematically limited to the value of the Product in question determined on the date of its sale and without the possibility of recourse against the brand or the company producing the product.

ARTICLE 13 – LEGAL INFORMATION

The provision of nominative information collected for the purpose of distance selling is mandatory, this information being essential for the processing and routing of orders, the establishment of invoices, and warranty contracts. Failure to provide information leads to the non-validation of the Order.

In accordance with the “Computer and Freedoms” law, the processing of nominative information concerning customers has been the subject of a declaration to the National Commission for Information Technology and Freedoms (CNIL).

The customer has (Article 34 of the law of January 6, 1978) a right of access, modification, rectification, and deletion of data concerning him, which he can exercise with X-Bar. In addition, X-Bar undertakes not to communicate, free of charge or in return, the contact details of its customers to a third party.
